Rob Lowe's legal battle against his former nanny, Jessica Gibson, is on hold, pending her appeal to a higher court to throw out his million-dollar lawsuit against her.
"Everything in the case comes to a halt for now," Gibson's lawyer Gloria Allred tells PEOPLE. "Although we were successful in getting parts of his lawsuit thrown out in an earlier decision, we feel most of it is still without merit."
The actor has accused Gibson, 25, of breaking her confidentiality agreement and spreading lies about him. At the time he filed his preemptive lawsuit, Lowe said a "former employee" – later identified as Gibson – "is demanding my wife Sheryl and I pay her $1.5 million by the end of the week or she will accuse us both of a vicious laundry list of false terribles." A week later, Gibson countersued him for sexual harassment, alleging the Brothers & Sisters star groped her and exposed himself over her seven-year employment with the Lowe family.
Lowe, 44, and his wife, Sheryl, 47, also preemptively sued a second former nanny, Laura Boyce, 38.
Boyce responded with her own sexual harassment claim against the couple, although she only accuses Sheryl of direct harassment.
Lowe's lawyer, Larry Stein, had no comment.

| ROB LOWE FIRES BACK AGAINST SECOND NANNY Blog |
Rob Lowe fired back Wednesday at a former nanny accusing him and his wife of harassment, alleging it was the nanny – and not his wife – who used a racial slur and behaved inappropriately.
In a response to Laura Boyce's claims against Lowe and wife Sheryl, the actor filed sworn statements in a Los Angeles Superior Court from people who knew and worked with Boyce.
"Laura would use the 'n-word' a lot when referring to her African-American friends and lovers," Boyce's former friend Noa Shaw said in her statement. "Laura was very open with her use of the 'n-word' in public."
In addition, the president of Lowe's production company, Jennifer Dynof, said in statement she had reprimanded Boyce "about her use of the ("n" word) around the children and the Lowe's friends."
Dynof also disciplined Boyce, 38, for openly taking about Boyce's sex life in the Lowe household.
Boyce's lawyer, Gloria Allred, told PEOPLE: "We will be filing our reply to (Lowe's allegations) within five days and it will contain our response."Boyce sued the Lowes in April, alleging that Sheryl Lowe created a "sexually offensive and hostile work environment" by using the n-word to describe Boyce's boyfriend and walking around "naked, completely exposing herself." Boyce does not accuse Rob Lowe of direct sexual harassment but is holding him jointly responsible.
The actor faces a separate legal battle with former nanny Jessica Gibson, who filed a lawsuit against the Lowes on April 14.
The Brothers & Sisters star, 44, preemptively filed lawsuits against both women on April 7, claiming they violated their confidentiality agreements and spread lies about his family.

| JUDGE DISMISSES SEVERAL CLAIMS IN ROB LOWE-NANNY SEX CASE Blog |
A judge tossed out several claims on both sides of Rob Lowe's legal battle with ex-nanny Jessica Gibson on Thursday.
He dismissed four of the Lowe's claims — including his allegation of defamation. (A judge ruled that Gibson, 24, is protected under laws that allow people to protest against their workplace condition.)
"He lost the heart of his case, which is defamation, and we are permitted to proceed with the heart of our case, which was - and still is - our allegation that Rob Lowe sexually harassed Jessica," Gibson's attorney, Gloria Allred, told TMZ.com.
But the judge also took a swipe at Gibson, throwing out her claim that Lowe, 44, retaliated against her. (A judge previously tossed out two of her allegations related to labor-code violations.)
"I'm delighted with the court's ruling today," Lowe's attorney, Larry Stein, told TMZ. "It removed the retaliation claim, which Ms. Allred had been focusing on, and left in six claims, which allows us to prosecute every claim we've made."
The hearing is the latest in the scandal-laden court battle.
On April 7, Lowe and his wife Sheryl filed a preemptive lawsuit against Gibson, accusing her of demanding $1.5 million in hush money.
A week later, Gibson filed her own lawsuit against the Lowes. She accused him of groping her and exposing himself to her.
She also alleged that his wife, Sheryl, would walk around the house naked and make vulgar comments about their sex life, according to the 18-page document.
The Lowes vehemently deny all of Gibson's allegations.
After Gibson filed her suit, a second former nanny, Laura Boyce, came forth claiming Sheryl sexually harassed her.
